Instructions for Filing Real Estate Transfer Only
A Real Estate Transfer Only may be filed if:
- Six months has passed since the date of death
- The sole probate asset of the decedent’s estate is real estate
- The decedent was not subject to Medicaid Estate Recovery
What I need when I file:
- The original Last Will and Testament (if one exists)
- Receipt of a paid funeral bill.
- The date of death value of real property as found in Belmont County Auditor’s Office property records and or original appraisal.
- An accurate legal description and or copy of the deed
- A Copy of the Death Certificate.
File these forms (if there is an original Will):
- Form 2.0 – Application to Probate Will
- Form 2.1 – Waiver of Notice of Probate of Will
- Form 2.4 – Certificate of Service of Notice of Probate of Will
- Form 1.0 – Surviving Spouse, Next of Kin
- Form 12.0 – Application for Certificate of Transfer
- Form 12.1 – Certificate of Transfer
File these forms (if there is not an original Will):
- Form 1.0 – Surviving Spouse, Next of Kin
- Form 12.0 – Application for Certificate of Transfer
- Form 12.1 – Certificate of Transfer
Filing Fee:
- The filing fee is $100.00
- If you use a credit card, a 4% charge will be added.
- Transferring real estate may require an additional fee.
